Subject: Request for Manifestation Determination Review and Suspension Review - Henry Slater Dear Ms. Eigenrauch and Ms. Fitzsimmons, We are writing in response to the suspension notice dated February 11, 2026, regarding our son, Henry Slater. Pursuant to the Individuals with Disabilities Education Act (IDEA) and 34 C.F.R. ยง 300.530(e), we hereby request a Manifestation Determination Review (MDR) to determine whether Henry's behavior on February 10-11, 2026, was caused by or had a direct and substantial relationship to his disability. The ABC data and behavioral documentation provided by Everett Elementary over the past five months (September 2025 - February 2026) demonstrate a consistent pattern of disability-related behaviors that the school has been accommodating through removal protocols and break room strategies. We believe this suspension is inconsistent with the school's prior treatment of these same behaviors. Additionally, pursuant to Board Policy 7:190-21 and Illinois School Code Section 10-22.6, we request a formal review of the suspension issued on February 11, 2026. We believe the 3-day out-of-school suspension is inappropriate given Henry's disability and the school's long-standing knowledge of his behavioral needs. We request the following: 1. **Manifestation Determination Review** to be held within 10 school days, with Henry's full IEP team present 2. **Emergency IEP meeting** to review the adequacy of Henry's current Behavioral Intervention Plan (BIP) and discuss additional supports needed 3. **Suspension review** as provided under District policy We will be consulting with a special education attorney regarding this matter. Please confirm receipt of this request and provide dates for the MDR and suspension review within 3 business days. Henry remains entitled to a Free Appropriate Public Education (FAPE) during this process, including access to make-up work and educational services during the suspension period.
